Terms of Use

• You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account and enter into these Terms on your own behalf.
• If you are between 13 and 18 years of age (or the relevant age of digital consent in your jurisdiction), you may use the Platform only with the involvement, consent, and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
• Where courses are offered to schools or K-12 learners through an institutional partner, use is governed by the applicable institutional agreement in addition to these Terms.
• By using the Platform, you represent and warrant that you have the legal capacity to enter into a binding contract and are not barred from using the Services under the laws of India or any other applicable jurisdiction.

• To access most Services, you must register for an account and provide accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You agree to notify us immediately at [Insert Support Email] of any unauthorised use of your account or any other breach of security.
• We reserve the right to suspend or terminate accounts that contain inaccurate, outdated, or fraudulent information, or that are used in violation of these Terms.
• One account is intended for use by a single individual. Sharing of login credentials, or simultaneous use of a single account by multiple individuals, is prohibited unless expressly permitted under a separate institutional or enterprise agreement.

• The Platform provides access to online courses, video lectures, assessments, assignments, downloadable resources, discussion forums, and, where applicable, live or proctored sessions (collectively, "Course Content").
• Course Content is provided for personal, non-commercial, educational use only, unless you have a separate written agreement with us permitting broader use (e.g., a corporate training licence).
• Access to a course is generally granted for the duration specified at the time of purchase or enrolment ("Access Period"). Access may expire at the end of this period unless renewed or extended.
• Certificates, badges, or credentials issued upon course completion are provided solely to evidence completion of the relevant Course Content on the Platform. They do not constitute a degree, diploma, or accreditation from any government body or accredited educational institution unless expressly stated.
• We may modify, update, discontinue, or replace Course Content, instructors, or specific features at our discretion, and will use reasonable efforts to notify enrolled Users of material changes affecting an active course.
• For proctored assessments, you consent to identity verification and, where applicable, recording of your screen, webcam, and/or audio for the purposes of academic integrity, in accordance with our Privacy Policy.

• Fees for courses and Services are as displayed on the Platform at the time of purchase, inclusive or exclusive of applicable taxes (such as GST) as indicated at checkout.
• Payments are processed through third-party, PCI-DSS compliant payment gateways. We do not store your full payment card details on our servers.
• All fees are payable in advance unless otherwise agreed in writing. We reserve the right to change course pricing at any time; changes will not affect fees already paid for an active enrolment.
• Refunds, where applicable, are governed by our Refund Policy [Insert link to Refund Policy], which forms part of these Terms. Unless otherwise stated in that policy, fees are generally non-refundable once a course has been accessed beyond a specified threshold (e.g., 10% of content viewed) or after a specified cooling-off period (e.g., 7 days from purchase), whichever is earlier.
• EMI, instalment, or third-party financing options, where offered, are subject to the separate terms and conditions of the relevant lending or financing partner.
• Failed, disputed, or charged-back payments may result in suspension of access to the relevant course until the matter is resolved.

• All content on the Platform, including but not limited to video lectures, text, graphics, logos, course structure, assessments, software, and the compilation and arrangement thereof ("Platform Content"), is owned by or licensed to SkillEdu VARSITY and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws in India and internationally.
• Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and view Course Content for your personal, non-commercial educational use during your Access Period.
• You may not copy, reproduce, distribute, publicly display, sell, rent, lease, sublicense, modify, create derivative works from, reverse-engineer, or otherwise exploit any Platform Content, in whole or in part, without our prior written consent.
• Downloading, screen-recording, screen-sharing, or otherwise capturing Course Content for redistribution outside the Platform is strictly prohibited, except where a specific resource is expressly marked as downloadable for offline personal use.
• Any feedback, suggestions, or ideas you submit to us regarding the Platform may be used by us without any obligation to compensate you, unless otherwise agreed in writing.
• All trademarks, service marks, and logos of SkillEdu VARSITY are our exclusive property. Nothing in these Terms grants you any right to use our trademarks without our prior written permission.

• The Platform may allow you to submit content such as assignments, project submissions, forum posts, comments, reviews, and ratings ("User Content").
• You retain ownership of your User Content, but you grant SkillEdu VARSITY a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, display, and use such User Content for the purposes of operating, promoting, and improving the Platform (e.g., displaying student reviews, showcasing anonymised project work with your consent).
• You represent and warrant that your User Content does not infringe the intellectual property, privacy, or other rights of any third party, and does not violate any applicable law.
• We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content that we consider, in our sole discretion, to violate these Terms or applicable law.

You agree that you will not, and will not permit any third party to:

• Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity, including during proctored examinations.
• Engage in academic dishonesty, including plagiarism, unauthorised collaboration during assessments, or the use of unauthorised aids during proctored examinations.
• Upload or transmit viruses, malware, or any other malicious code, or attempt to gain unauthorised access to the Platform, other Users' accounts, or our systems and networks.
• Use any automated means (bots, scrapers, crawlers) to access, extract, or interact with the Platform without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Platform, including through denial-of-service attacks or excessive automated requests.
• Post or transmit any content that is defamatory, obscene, harassing, hateful, discriminatory, or otherwise objectionable, or that infringes the intellectual property or privacy rights of any third party.
• Use the Platform to advertise or solicit any other party to buy or sell products or services not offered by SkillEdu VARSITY, without our prior written consent.
• Reverse-engineer, decompile, or disassemble any portion of the Platform's software, except to the extent such restriction is prohibited by applicable law.

We reserve the right to investigate and take appropriate action against any User who violates this Section, including removing content, suspending or terminating accounts, and, where necessary, reporting to law-enforcement authorities.

The Platform may contain links to, or integrate with, third-party websites, payment gateways, plugins, or services (e.g., video-conferencing tools, social-media login, analytics providers) that are not owned or controlled by SkillEdu VARSITY. We do not endorse and are not responsible for the content, accuracy, or practices of any third-party services. Your use of any third-party service is governed by that third party's own terms and privacy policy.

To the maximum extent permitted by applicable law:

• The Platform and all Course Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Platform will be uninterrupted, timely, secure, or error-free.
• We do not guarantee any specific learning outcome, employment outcome, salary increase, or placement as a result of completing any course, even where placement assistance or career support is offered.
• We do not warrant that any errors or defects will be corrected, or that the Platform or the servers that make it available are free of viruses or other harmful components.
• Nothing in this Section limits or excludes any liability that cannot be limited or excluded under applicable law, including the Consumer Protection Act, 2019 of India.

To the maximum extent permitted by applicable law, SkillEdu VARSITY, its directors, employees, instructors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the Platform, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the total amount actually paid by you to SkillEdu VARSITY for the specific course or Service giving rise to the claim in the twelve (12) months preceding the event giving rise to the liability.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Indian law or the law of your jurisdiction of residence.

You agree to indemnify, defend, and hold harmless SkillEdu VARSITY, its officers, directors, employees, instructors, licensors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any User Content submitted by you.

• We may suspend or terminate your account and access to the Platform, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or posed a security risk to the Platform or other Users.
• You may terminate your account at any time by contacting us at [Insert Support Email] or through your account settings, subject to the terms of our Refund Policy regarding any active paid enrolments.
• Upon termination, your right to access the Platform and any Course Content will cease immediately. Provisions of these Terms that by their nature should survive termination (including Sections 5, 6, 9, 10, 11, and 14) shall survive.

We may modify, suspend, or discontinue any part of the Platform or the Services at any time, with or without notice. We may also revise these Terms from time to time to reflect changes in our practices, technology, or applicable law. We will post the updated Terms on this page with a revised "Last Updated" date and, where changes are material, provide additional notice (such as an email or in-app notification). Your continued use of the Platform after such changes take effect constitutes your acceptance of the revised Terms.

14.1 Users in India
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-law principles. Subject to Section 14.3 below, the courts at [Insert City, e.g., Hyderabad / Bengaluru], Telangana, India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

14.2 International Users
If you access the Platform from outside India, you agree that these Terms are nonetheless governed by Indian law as set out above, except where mandatory consumer-protection laws of your own country of residence grant you additional or different rights that cannot be waived by agreement (in which case, those mandatory local protections will apply to the extent required by law).

14.3 Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the matter amicably through good-faith negotiation by contacting us at [Insert Grievance/Legal Contact Email]. If the dispute is not resolved within thirty (30) days, either party may refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996, to be conducted by a sole arbitrator mutually appointed by the parties, with the seat and venue of arbitration at [Insert City], India, and the proceedings conducted in the English language. This Section does not preclude either party from seeking urgent injunctive relief from a court of competent jurisdiction where necessary.

In accordance with the Information Technology Act, 2000, and the rules made thereunder, the details of our Grievance Officer are as follows:

The Grievance Officer will acknowledge complaints promptly and endeavour to resolve them within the timelines prescribed under applicable law.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions of these Terms shall continue in full force and effect. No failure or delay by SkillEdu VARSITY in exercising any right under these Terms shall operate as a waiver of that right.

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy (each incorporated herein by reference), constitute the entire agreement between you and SkillEdu VARSITY regarding your use of the Platform, and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
